These Terms & Conditions apply to services supplied by AM Safe Limited (“AM Safe”, “we”, “us” or “our”) to customers (“the Client”, “you” or “your”).
AM Safe Limited provides carpentry, fire-door installation, building, refurbishment, repair and general property maintenance services to domestic, commercial and public-sector clients.
By accepting a quotation, instructing AM Safe Limited to commence work, paying a deposit, or otherwise entering into an agreement with us, the Client agrees to these Terms & Conditions.
1. Quotations
Unless otherwise stated, quotations issued by AM Safe Limited are valid for 30 days from the date of issue.
Our quotations are based on the information, drawings, measurements and site conditions reasonably available to us at the time of pricing.
Only work specifically described within the quotation is included in the quoted price. Any additional work, alterations or items not expressly included will be treated as a variation and may incur additional charges.
Where dimensions, quantities or specifications change following acceptance of the quotation, AM Safe Limited reserves the right to revise the price accordingly.
Obvious clerical, typographical or calculation errors within quotations or other documents may be corrected.
2. Acceptance of Works
A quotation may be accepted in writing, electronically, by payment of a requested deposit, or by instructing AM Safe Limited to proceed with the works.
Once accepted, the quotation together with these Terms & Conditions will form the basis of the agreement between AM Safe Limited and the Client.
3. Deposits & Advance Payments
AM Safe Limited may require a deposit or advance payment before ordering materials, booking labour or commencing work.
The amount required will be stated on the quotation or invoice.
Where materials are specially manufactured, made to measure, non-returnable or ordered specifically for the Client's project, payment for those materials may be required in full before they are ordered.
Deposits will be dealt with in accordance with the Client's statutory rights and applicable UK consumer law.
4. Payment Terms
Payment terms will be stated on the relevant quotation or invoice.
Unless otherwise agreed in writing, invoices are payable by the due date shown on the invoice.
For larger projects, AM Safe Limited may operate staged payments based on agreed milestones, materials ordered, work completed or other agreed stages of the project.
The Client must not unreasonably withhold payment for completed and properly invoiced works.
For business-to-business contracts, AM Safe Limited reserves its statutory rights regarding interest and compensation on qualifying late commercial payments.
5. Additional Works & Variations
Any work requested by the Client that falls outside the original agreed scope may be treated as a variation.
Where reasonably practicable, the cost of additional work will be agreed before that work is undertaken.
However, where unforeseen work is necessary to make the installation safe, compliant, structurally sound or capable of progressing, AM Safe Limited will notify the Client as soon as reasonably practicable.
Additional labour, materials, plant, access equipment or subcontractor costs arising from approved variations may be charged separately.
6. Unforeseen & Hidden Conditions
Our quotations are based on visible and reasonably identifiable site conditions.
During construction, refurbishment and maintenance work, previously concealed problems may become apparent. These can include, but are not limited to:

rotten or damaged timber;

structural defects;
-
unsuitable existing construction;
-
defective substrates;
-
hidden services;
-
damp or water damage;
-
asbestos or other hazardous materials;
-
non-compliant previous workmanship;
-
concealed electrical or plumbing services;
-
defective existing door frames or linings; and
-
other conditions that could not reasonably have been identified before work commenced.
Remedial work required as a result of previously concealed conditions is not included unless expressly stated within the quotation.
Where such conditions are discovered, we will explain the issue to the Client and, where appropriate, provide details of additional costs before proceeding with additional work.
7. Client Responsibilities
The Client is responsible for providing reasonable access to the property and work areas at the agreed times.
Unless otherwise agreed, the Client must ensure that the work area is reasonably clear and accessible before work begins.
The Client must inform AM Safe Limited of any known hazards, asbestos, hidden services, structural issues or other relevant information that may affect the safe completion of the works.
Where necessary, the Client is responsible for obtaining appropriate permissions, licences, landlord/freeholder consent, planning permission, building-control approval or other approvals unless our quotation specifically states that AM Safe Limited will arrange them.
8. Programme & Completion Dates
Any commencement or completion dates provided by AM Safe Limited are given in good faith.
We will make reasonable efforts to complete the works within the anticipated programme. However, dates may be affected by circumstances outside our reasonable control, including material shortages, supplier delays, adverse weather, site conditions, access restrictions, illness, delays by other contractors, changes requested by the Client or unforeseen works.
Where delays occur, we will endeavour to keep the Client reasonably informed.
9. Materials
Unless otherwise stated, materials supplied by AM Safe Limited will be suitable for their intended purpose and consistent with the specification contained within our quotation.
Natural materials such as timber may vary in colour, grain, texture and appearance. These natural variations do not normally constitute defects.
Where an exact product becomes unavailable, we will discuss suitable alternatives with the Client before making a material substitution where that substitution would materially affect the specification or appearance.
Materials supplied by the Client remain the Client's responsibility in relation to their suitability, quality, dimensions and availability unless AM Safe Limited has expressly agreed otherwise.
10. Fire Doors & Fire-Safety Work
Where AM Safe Limited undertakes fire-door installation, repair, maintenance or associated fire-safety work, the work will be carried out in accordance with the agreed specification and applicable requirements relevant to the project.
The performance of a fire-door assembly depends upon the compatibility and condition of the complete doorset or assembly, including the door leaf, frame or lining, hinges, closers, seals, glazing, ironmongery and surrounding construction.
Where existing components are retained, AM Safe Limited cannot accept responsibility for defects or non-compliance within existing components that are outside our agreed scope of work.
Any certification, inspection, sign-off or third-party accreditation will only be provided where specifically included within the quotation or contract and where the relevant installation satisfies the applicable requirements.
11. Existing Structures & Finishes
AM Safe Limited will take reasonable care when carrying out work to existing buildings.
Construction and refurbishment work can sometimes cause minor disturbance to existing finishes, particularly where old components must be removed or where access is restricted.
Unless specifically included within our quotation, extensive redecoration or making good beyond the immediate area affected by our work is excluded.
We are not responsible for defects in existing structures, finishes or installations that were not caused by our work.
12. Waste & Site Cleaning
Removal and disposal of waste will only be included where specified within the quotation.
Where waste removal is included, AM Safe Limited will dispose of relevant construction waste using appropriate methods.
Unless otherwise agreed, the work area will be left reasonably clean and tidy following completion.
A professional deep clean is not included unless expressly stated.
13. Subcontractors
AM Safe Limited may use suitably experienced subcontractors or specialist trades to undertake elements of the works.
Where subcontractors are engaged by AM Safe Limited as part of our contracted works, AM Safe Limited will remain responsible for managing the work included within our agreed scope.
14. Electrical, Plumbing & Specialist Works
Electrical, plumbing, gas and other specialist works will only be included where expressly stated within our quotation.
Where specialist certification is required, appropriately qualified or competent contractors will be used where required by law or the applicable regulatory framework.
15. Access Equipment
Scaffolding, towers, mechanical access equipment, lifting equipment and other specialist access arrangements are excluded unless specifically stated within the quotation.
If additional access equipment becomes necessary due to site conditions that could not reasonably have been identified when the quotation was prepared, this may result in an additional charge subject to agreement with the Client.
16. Completion & Defects
The Client should notify AM Safe Limited as soon as reasonably possible if they believe there is a defect in our workmanship.
We will be given a reasonable opportunity to inspect the alleged defect and, where the issue results from defective workmanship for which AM Safe Limited is responsible, to carry out appropriate remedial work.
This does not affect any statutory rights available to consumers.
AM Safe Limited is not responsible for defects caused by normal wear and tear, misuse, accidental damage, alterations by others, lack of maintenance, defective Client-supplied materials or components, movement of the existing building, water ingress from unrelated sources, or matters outside our original scope of work.
17. Cancellation
Cancellation rights will depend on the nature of the contract and whether the Client is acting as a consumer or business.
Where applicable, consumers may have statutory cancellation rights, particularly where contracts are entered into online, by telephone or away from our business premises.
Nothing within these Terms & Conditions is intended to remove or restrict any statutory cancellation rights.
Where a Client cancels work after materials have been ordered, work has commenced or costs have otherwise reasonably been incurred, the Client may be responsible for costs properly due under the contract, subject to applicable consumer law.
Special-order, personalised or made-to-measure goods may be subject to different cancellation rights where permitted by law.
18. Health & Safety
AM Safe Limited takes health and safety seriously and will take reasonable steps to maintain a safe working environment.
Clients, occupants and visitors should follow reasonable safety instructions given by AM Safe Limited and should avoid entering designated work areas without permission while works are underway.
AM Safe Limited reserves the right to suspend work where we reasonably consider conditions to be unsafe.
19. Liability
AM Safe Limited will exercise reasonable care and skill when providing its services.
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory rights that cannot legally be excluded.
Subject to applicable law, AM Safe Limited will not be responsible for losses caused by matters outside our reasonable control or by defects in existing structures, installations or Client-supplied products that are outside our agreed scope.
20. Photographs
AM Safe Limited may wish to photograph completed work for record-keeping, quality-control, portfolio, website or marketing purposes.
Where photographs could identify a private residential property, individual, confidential information or other sensitive details, appropriate permission will be obtained where required.
Clients may ask us not to use photographs of their project for marketing purposes.
21. Website Information
Information provided on the AM Safe Limited website is intended to provide general information about our company and services.
While we take reasonable care to keep information accurate and current, website content does not constitute a quotation, contractual offer or professional advice specific to an individual project.
Prices, specifications and availability may change.
22. Intellectual Property
Unless otherwise stated, the content, branding, graphics, photographs and written material on the AM Safe Limited website are owned by or licensed to AM Safe Limited.
They may not be reproduced, distributed or commercially used without permission, except where permitted by law.
23. Privacy & Personal Information
Personal information will be handled in accordance with applicable UK data-protection legislation and our Privacy Policy.
Information supplied by Clients will only be used for legitimate purposes connected with enquiries, quotations, projects, invoicing, legal obligations, administration and other permitted business activities.
24. Complaints
If a Client is dissatisfied with any aspect of our service, they should contact AM Safe Limited as soon as possible so that we have an opportunity to investigate and resolve the matter.

We aim to deal with complaints fairly and within a reasonable timeframe.
25. Consumer Rights
Nothing within these Terms & Conditions is intended to restrict or exclude the statutory rights of consumers under applicable UK law.
Where any provision within these Terms & Conditions conflicts with a mandatory statutory consumer right, the statutory right will take precedence.
26. Governing Law
These Terms & Conditions and any contractual relationship between AM Safe Limited and the Client will be governed by the applicable laws of England and Wales.
Any disputes will be dealt with by the courts having jurisdiction under applicable law.
